ಬೆಂಗಳೂರು; ಆರೋಗ್ಯ ಕವಚ 108 ಯೋಜನೆಯಲ್ಲಿನ ಲೋಪ ದೋಷಗಳ ಬಗ್ಗೆ ಪ್ರಧಾನ ಮಹಾಲೇಖಪಾಲರು ನೀಡಿದ್ದ ವರದಿ ಆಧರಿಸಿ ಪರಿಶೀಲನೆ ಕೈಗೆತ್ತಿಕೊಂಡಿದ್ದ ಸಾರ್ವಜನಿಕ ಲೆಕ್ಕಪತ್ರ ಸಮಿತಿಗೂ ಉದ್ದೇಶಪೂರ್ವಕವಾಗಿ ಸರ್ಕಾರವು ಭಾಗಶಃ ಮಾಹಿತಿಯನ್ನಷ್ಟೇ ನೀಡಿತ್ತು. ಅಲ್ಲದೇ ನ್ಯಾಯಾಲಯವು ಈ ಸಂಬಂಧ ಅವಲೋಕಿಸಿದ್ದ ಅಂಶಗಳನ್ನೂ ನೀಡದೆಯೇ ಸಾರ್ವಜನಿಕ ಲೆಕ್ಕಪತ್ರ ಸಮಿತಿಯನ್ನೇ ಕತ್ತಲೆಯಲ್ಲಿಟ್ಟಿತ್ತು ಎಂಬುದು ಇದೀಗ ಬಹಿರಂಗವಾಗಿದೆ.
ಈ ಕುರಿತು ಸಾರ್ವಜನಿಕ ಹಿತಾಸಕ್ತಿ ರಿಟ್ ಅರ್ಜಿ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ನಡೆದ ವಿಚಾರಣೆಗಳಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಒಟ್ಟು 25 ದಿನಾಂಕಗಳಂದು ವಿಚಾರಣೆ ನಡೆದಿದೆ. ಆದರೆ ಸಾರ್ವಜನಿಕ ಲೆಕ್ಕಪತ್ರ ಸಮಿತಿಗೆ ಕೇವಲ 4 ವಿಚಾರಣೆಗಳಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಮಾಹಿತಿ ನೀಡಿತ್ತು. ಉಳಿದ 21 ವಿಚಾರಣೆಗಳ ಬಗ್ಗೆ ಮಾಹಿತಿಯನ್ನೇ ನೀಡಿರಲಿಲ್ಲ. ಈ ಸಂಬಂಧ ಕಡತಗಳನ್ನೇ ಸಮಿತಿಯಿಂದ ಮರೆಮಾಚಿರುವುದು ಮೇಲ್ನೋಟಕ್ಕೆ ಕಂಡುಬಂದಿದೆ.
ಆರೋಗ್ಯ ಕವಚ ಟೆಂಡರ್ ನೀಡಿಕೆಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಭ್ರಷ್ಟಾಚಾರ ನಡೆದಿದೆ ಎಂದು ಆರೋಪಿಸಿ ಕರ್ನಾಟಕ ಪ್ರದೇಶ ಕಾಂಗ್ರೆಸ್ ಸಮಿತಿಯು ಲೋಕಾಯುಕ್ತಕ್ಕೆ ದೂರು ಸಲ್ಲಿಸಿರುವ ಬೆನ್ನಲ್ಲೇ ಸಾರ್ವಜನಿಕ ಲೆಕ್ಕಪತ್ರ ಸಮಿತಿ ನಡೆದಿದ್ದ ಚರ್ಚೆಯು ಮುನ್ನೆಲೆಗೆ ಬಂದಿದೆ. ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ಕೆಲ ದಾಖಲೆಗಳು ‘ದಿ ಫೈಲ್’ಗೆ ಲಭ್ಯವಾಗಿವೆ.
ಅಲ್ಲದೇ ಈ ಯೋಜನೆ ಅನುಷ್ಠಾನಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ತಾಂತ್ರಿಕ ಸಮಿತಿ, ಪರಿಣಿತರ ಸಮಿತಿ ಸೇರಿದಂತೆ ಹಲವು ಸಮಿತಿಗಳನ್ನು ರಚಿಸಲಾಗಿದೆ ಎಂದು ನ್ಯಾಯಾಲಯಕ್ಕೆ ಪ್ರಮಾಣಪತ್ರಗಳನ್ನು ಸಲ್ಲಿಸಿದ್ದ ಸರ್ಕಾರವು ವಾಸ್ತವದಲ್ಲಿ ಯಾವ ತಜ್ಞರ ಹೆಸರನ್ನೂ ಕಡತದಲ್ಲಿ ನಮೂದಿಸಿರಲಿಲ್ಲ. ತಜ್ಞರ ಅಭಿಪ್ರಾಯವೂ ಇಲ್ಲ, ಯಾವ ತಾಂತ್ರಿಕ ತಜ್ಞರೂ ಸಲಹೆ ನೀಡಿಲ್ಲ ಎಂಬುದು ದಾಖಲೆಗಳಿಂದ ಗೊತ್ತಾಗಿದೆ.
ಹಾಗೆಯೇ ಸಾರ್ವಜನಿಕರ ಅಭಿಪ್ರಾಯಗಳು ಮತ್ತು ತಜ್ಞರ ಅಭಿಪ್ರಾಯದ ಮೇಲೆ ಟೆಂಡರ್ ರದ್ದುಗೊಳಿಸಲಾಗಿದೆ ಎಂದು ಸರ್ಕಾರ ಹೇಳಿದ್ದರೂ ಇದಕ್ಕೆ ಸ್ಟಷ್ಟ ಆಧಾರಗಳನ್ನು ಸಾರ್ವಜನಿಕ ಲೆಕ್ಕಪತ್ರ ಸಮಿತಿಗೆ ಒದಗಿಸದಿರುವುದು ಹಲವು ಅನುಮಾನಗಳಿಗೆ ದಾರಿಮಾಡಿಕೊಟ್ಟಿದೆ.
ಯಾವ ಸಮಿತಿಗಳು ಏನೆಂದು ಅಭಿಪ್ರಾಯ ನೀಡಿದ್ದವು, ಯಾವ ತಜ್ಞರು ಇದರ ಬಗ್ಗೆ ಮಾತನಾಡಿದರು, ಮಂತ್ರಿಗಳಿಗೆ ಯಾರು ಹೇಳಿದರು, ಅದರ ಆಧಾರದ ಮೇಲೆ ಅವರು ಅಧಿಕಾರಿಗಳ ಜತೆ ಚರ್ಚೆ ಮಾಡಿದ್ದಾರೆಯೇ, ಮಾಡಿದ್ದರೆ ಅದರ ನಡವಳಿಗಳು ಇವೆಯೇ ಎಂಬಿತ್ಯಾದಿ ವಿವರಗಳನ್ನು ಸಮಿತಿಗೆ ನೀಡದೇ ಮುಚ್ಚಿಟ್ಟಿರುವುದು ಮೇಲ್ನೋಟಕ್ಕೆ ಕಂಡು ಬಂದಿದೆ.
ಡಿಸೆಂಬರ್ಗಿಂತ ಮುಂಚೆ 2021ರ ನವೆಂಬರ್ 10ರಂದು ವಿಚಾರಣೆ ಆಗಿದೆ. ನವೆಂಬರ್ 2021ರಲ್ಲಿ ‘we cannot appreciate the manner in which the state government is proceeding with the matter of providing emergency medical ambulances ಎಂದು ಹೈಕೋರ್ಟ್ ಹೇಳಿತ್ತು. ಅದಕ್ಕೆ ಮೊದಲು ಜುಲೈ 29ರಂದು this court was monitoring the tender process. the order passed by this court record a prima facie views of this court about the illegality of the said decision taken on ಎಂದು 17th december 2020ರಲ್ಲಿ ಹೇಳಿತ್ತು.
ಡಿಸೆಂಬರ್ 17ರ ನಿರ್ಧಾರ ಏನಂದರೆ ಸಚಿವರು 2020ರ ಡಿಸೆಂಬರ್ 17ರಂದು ಟೆಂಡೆರ್ನ್ನು ನಿಲ್ಲಿಸಿ ಎಂದು ಪತ್ರ ಬರೆದಿದ್ದರು. ಅದರ ಆಧಾರದ ಮೇಲೆಯೇ ಸರ್ಕಾರವು ಟೆಂಡರ್ನ್ನು ರದ್ದುಗೊಳಿಸಿತ್ತು. ಅದೇ ದಿನ ನ್ಯಾಯಾಲಯವು the order passed by thd Hon’ble Minister for Helath and Family Welfare and Medical Education withdrawing the earlier order dated 17th december, it is for the the Government to decide whether it wants to give an assurance to this court that the fresh tender will not be canceelef without the leave of this court,’ ಎಂದು ನ್ಯಾಯಾಲಯವು ತೀವ್ರ ಅಸಮಾಧಾನದಿಂದ ಹೇಳಿತ್ತು.
ಇಲ್ಲಿಯವರೆಗಷ್ಟೇ ಸಾರ್ವಜನಿಕ ಲೆಕ್ಕಪತ್ರ ಸಮಿತಿಗೆ ಸರ್ಕಾರವು ಮಾಹಿತಿ ನೀಡಿತ್ತು. ಇದರ ಹಿಂದೆ ಕೋರ್ಟ್ನಲ್ಲಿ ಏನಾಯಿತು ಎಂಬ ಬಗ್ಗೆ ಸಮಿತಿಗೆ ಒಂದೇ ಒಂದು ಮಾಹಿತಿಯನ್ನೂ ನೀಡಿಲ್ಲ. ಆದರೆ 2021ರ ಮಾರ್ಚ್ನಲ್ಲಿ ನ್ಯಾಯಾಲಯವು ‘This affidavit tries to put on record certain additional reasons for cancellation of the earleir tender process and the said reasons are not found in the order of cancellation of the earlier tender process. Now reliance is place on what is done by the subsequnelty constituted advisory committee,’ ಎಂದು ಅವಲೋಕಿಸಿತ್ತು.
ಟೆಂಡರ್ ರದ್ದುಗೊಳಿಸುವಾಗ ಯಾವ ಕಾರಣಗಳನ್ನು ಕೊಟ್ಟಿದ್ದರು ಆ ಕಾರಣಗಳು ಎಲ್ಲಿಯೂ ಇರಲಿಲ್ಲ. ಯಾರೂ ದಾಖಲಿಸಿಲ್ಲ. ಅಂದರೆ ಎಲ್ಲಿಯೂ ತಜ್ಞರ ಸಮಿತಿಯೇ ಇರಲಿಲ್ಲ. ಆದರೆ ಆ ಕಾರಣಗಳನ್ನು ತಾಂತ್ರಿಕ ತಜ್ಞರ ಸಮಿತಿಯವರು ಕೊಟ್ಟಿದ್ದಾರೆ ಎಂದು ನೆಪ ಮುಂದಿರಿಸಿದ್ದ ಇಲಾಖೆಯು ಟೆಂಡರ್ ರದ್ದುಗೊಳಿಸಿದೆ ಎಂದು ನ್ಯಾಯಾಲಯವು ಅವಲೋಕಿಸಿತ್ತು.
2021ರ ಫೆಬ್ರುವರಿಯಲ್ಲಿ the last order notes that in the file there is not even a single opinion of experts which is referred in paragraph 5 of the said order. it is also directed by the said order to the state government to place on record in which public forum the issue of tender was disscussed ‘ ಎಂದು ಹೇಳಿತ್ತು. ಅಂದರೆ ಅಲ್ಲೆಲ್ಲೂ ಸಾರ್ವಜನಿಕ ವೇದಿಕೆಯೇ ಇಲ್ಲ ಎಂದು ಹೇಳಿತ್ತು. ಅಷ್ಟೇ ಅಲ್ಲದೆ ‘in the affidavit it is stated that there are no written opinions of any experts. however, the names of the experts whose opinion was relied upon in the order have not been disclosed in the affidavit,’ ಎಂದು ಹೇಳಿತ್ತು.
ಇದರರ್ಥ ತಜ್ಞರ ಅಭಿಪ್ರಾಯವೇ ಇರಲಿಲ್ಲ ಮತ್ತು ಯಾರು ತಜ್ಞರು ಎಂದು ಹೆಸರುಗಳನ್ನೂ ನ್ಯಾಯಾಲಯಕ್ಕೆ ನೀಡಿರಲಿಲ್ಲ. in the file we find that there is not even a single opinion of expert which is referred in paragaraph 5. we direct the state government to file an affidavit placing on record in which public forum the issue of tender was discussed’ ಎಂದೂ ಹೇಳಿತ್ತು.
ಅಲ್ಲದೇ 20221ರ ಜನವರಿಯಲ್ಲಿ ರಾಜ್ಯ ಸರ್ಕಾರದ ಅಡ್ವೋಕೇಟ್ ಜನರಲ್ ಅವರು ‘the tender process has been cancelled and a High Power Committee has been appointed. This stand taken by the State Government is Schocking considering the orders passed by this court and the assurance given to this court by the government,’ ಎಂದು ಹೇಳಿದ್ದರು.
2020ರ ಅಕ್ಟೋಬರ್ನಲ್ಲಿ ಇದೇ ಕೋರ್ಟ್ the court is concerned that the process of acutally issuing the work order will be inordinateley delayed’ ಎಂದೂ ಹೇಳಿತ್ತು. ಈ ಯಾವ ಮಾಹಿತಿಯನ್ನೂ ಸರ್ಕಾರವು ಸಾರ್ವಜನಿಕ ಲೆಕ್ಕಪತ್ರ ಸಮಿತಿಗೆ ಒದಗಿಸಿಲ್ಲ.
